  • Defended a Fortune 100 corporation in 21 lawsuits related to a pediatric brain cancer cluster that the State of Florida declared in the Acreage area of Palm Beach County. There were two putative class action lawsuits encompassing 10,000 property owners. After a bench trial on class certification, the court denied the motions for class certification. There were several individual wrongful death and personal injury lawsuits. After a month-long trial, a jury returned a defense verdict, which was affirmed on appeal. The court granted summary judgment in the individual lawsuits.
  • Defended electronic nicotine delivery system manufacturer against state attorney general, personal injury and economic loss claims in thousands of lawsuits across the country including MDL, state consolidated, and class action opt-out cases. The representation included successful dismissal of hundreds of cases at the consolidated stage.
  • Defended Florida’s largest landowner in a class action regarding alleged contamination and pollution of land from paper mill waste products. The result was denial of class certification, which effectively ended the case.
  • Represented the largest utility in Florida in a federal environmental injunction case challenging construction of a major power plant on alleged toxic and pollution grounds, resulting in denial of the injunction.
  • Defended a class action involving claims of contamination by radon gas in a residential building. By attacking standing and certification the claims were resolved on favorable grounds.
  • Represented a major agricultural business in a class action and toxic tort case relating to agricultural crop burning, in which plaintiffs sought to certify a class of tens of thousands of residents. The claims were for alleged air pollution, and we demonstrated that the claims were baseless and air quality was at the highest level. Plaintiffs took a voluntary dismissal of their entire case, with prejudice.
  • Acted as coordinating discovery counsel for 3M’s multijurisdictional PFAS litigation (dubbed the “forever chemicals" cases), which was a huge conglomeration, including an MDL with over 10,000 cases, multiple state AG and environmental agency actions, and numerous nonconsolidated state and federal cases.
  • Defended dozens of toxic tort claims involving alleged contamination by a widely used fungicide, with multiple jury trials and defense verdicts.
  • Represented clients in toxic tort and insurance coverage matters involving chromated copper arsenate wood treatments and employee exposure claims linked to clean-room chemicals.
