On December 27, the Fifth Circuit realized it forgot CTA filers’ gift under the tree and turned the national car around, reinstating the nationwide injunction on enforcement of the CTA pending appeal. The balance of the government’s appeal remains and will be heard on an expedited basis by the Fifth Circuit. This means that compliance is again legally voluntary for filers. However, we continue to recommend voluntary filing as it is clear that this is a fast-developing situation which can change rapidly. In the event the government prevails, there could be a shortened timeline to comply so the prudent course remains filing.
